DUI PROGRAM PROCEDURES

Northeast Florida Safety Council is the Florida Department of Highway Safety and Motor Vehicles (DHSMV) licensed provider for the DUI education program for persons arrested for driving under the influence (DUI) of alcohol or other drugs. Educational classes and the evaluation are Mandated as per (Florida Statute 316.193) for persons with DUI offense/s and Florida Statute 322.271 Administrative Suspension.

To enroll you MUST reside, work, or attend school in Baker, Clay, Columbia, Duval, Hamilton, Lafayette, Nassau, St Johns and Suwannee Counties (3rd, 4th,8th Judicial circuits) in accordance with provisions of S322.292, Florida Statutes.

Proof of Residency is REQUIRED

Please note, this is a pre-Registration application. All information must first be verified by our office PRIOR to completing your enrollment process. You will be contacted by one of our Staff to complete enrollment process.

To register have the following information listed below, as this will assist you in the registration process:

  • Your Driver License Number
  • (Complete) Arrest Report /with officers’ narrative. This can be obtained at the Sherriff’s Department, Clerk of the Circuit/County Court in the county where the arrest occurred. If you had a traffic crash, you must provide a copy of that report, which can be obtained from the arresting agency.
  • Breath / Blood or Urine Test results or Refusal to Submit Affidavit
  • Arrest Citation / Ticket #
  • Any other information from courts, such as court date disposition, judgement of guilt, probation information, etc.

You must be able to EMAIL the above documentation or provide physical copies before your scheduled Evaluation appointment.

Evaluation
The purpose of the evaluation is to determine whether the client's use of alcohol and/or other drugs may subject the client to further future risk for driving under the influence. A referral to treatment is indicated if risk is determined. Failure to complete treatment may result in cancellation of the driving privilege by the Department of Highway Safety and Motor Vehicles. The cost of treatment is the responsibility of the client. The treatment referral may not be waived without a supporting "independent" evaluation conducted by an agency appointed by the court and with access to the original evaluation conducted by the DUI Program. The cost of this procedure shall be borne by the defendant. F.S. 316.193 (5)

If false or misleading information is given concerning previous DUI arrests, convictions, or previous attendance at a DUI program, in Florida or any other State, Northeast Florida Safety Council reserves the right to charge the full fee of the Level Two DUI program in addition to any fees associated with the Level Two DUI course.

90 Day Completion Requirement
Per Administrative Rule, any client who returns to the program more than ninety (90) days after the original enrollment to complete all or part of the program will have to re-enroll completely, including payment of all program fees.
Upon enrolling in the DUI Program, (Voluntarily, Court Ordered, or as a requirement of DHSMV) you will be required to complete the education course and the evaluation within 90 days of the original enrollment. If your DUI arrest is dropped or dismissed but the administrative suspension remains valid, you must still complete the DUI Program within the 90 days. Failure to complete within the first 90 days will result in repayment of the full fee and completion of both the education and evaluation components.

The Level I DUI program is a restricted program, designed for individuals who have had one alcohol and/or drug related traffic arrest/conviction in their lifetime.

The Level II DUI program is designed for clients who have been arrested and/or convicted of more than one alcohol, and/or drug related traffic offense in a lifetime, and/or, have previously attended a DUI Level I Drug and Alcohol Education Course, and/or have been convicted of two or more times of an offense requiring DUI program attendance.

Payment of fees is your acknowledgement and agreement to abide by All rules and regulations as outlined by the Program. All fees are non-refundable, regardless of Court outcome or administrative suspension is invalidated.

No additional fees shall be charged if:
 A.   You contact the program at least (5) five business days PRIOR to the date that the class or evaluation was scheduled and ask to be reassigned due to a conflict.
 B.   You contact the program at least (48) forty-eight hours AFTER the date of the scheduled class or evaluation and ask to be reassigned for exceptional circumstances that are beyond control and/or unknown to the client at the time of enrollment, defined as natural disaster, serious illness or death in the client's immediate family or illness requiring hospitalization and documented by the attending physician.

Student Conduct:
The following will be considered a breach of program procedures which may result in dismissal from the program, and may result in payment of the maximum Department approved reassignment fee:
A.  Strictly NO firearms or weapons are allowed on property, inside buildings and/or classrooms.
B.  Late arrival to any portion of Class (regardless of reason) missing a class or failure to return from breaks on time will result in dismissal with Required rescheduling of entire class and fees apply.
C.  Late arrival to an Evaluation appt. will forfeit that appt. and require Rescheduling with applicable fees.
D.  Attending after the use of alcohol and/or controlled drugs and/or an illegal substance/s or during your assigned Class or Evaluation is STRICTLY prohibited and will result in your dismissal and will REQUIRE re-enrollment of DUI Program with paying the FULL FEES due.
E.  The use of cells phones - texting/talking, audio and/or videorecording is STRICTLY prohibited while in class, during an evaluation and of NEFSC Staff will Result in Dismissal from Program with Rescheduling (applicable fees apply) or assignment to another Safety Council for services.
F.  Disruption at Registration, an Evaluation or at Class by using: Abusive language, foul, obscene, or inappropriate, in any form and/or unreasonable demands on staff, making threats in any manner will not be tolerated and will result in immediate contact with proper authorities and filing a formal complaint with Dept. of Motor Vehicles.
G.  Visitors, family, friends, and/or children are NOT PERMITTED (in the classroom or at your Evaluation).
H.  If you require assistance due to a language barrier you are to make proper arrangements for someone to translate.

The confidentiality of alcohol and drug abuse records maintained by this program is protected by 42 U.S.C. sections 290dd-22 Federal laws and 42 C.F.R. Part 2 Federal regulations. Client information cannot be disclosed without the written permission of the client, unless (1) allowed by a court order, (2) made to medical personnel in a medical emergency or to qualified personnel for research, audit, or program evaluation, (3) if the client commits or threatens to commit a crime either at the program or against any person who works for the program, or (4) client is suspected of child abuse or neglect.

Violation of the Federal law and regulations by the program is a crime. Suspected violations may be reported to the United States Attorney in the district where the violation occurs.

Federal law and regulations do not protect any information about suspected child abuse or neglect from being reported under the state law to appropriate state or local authorities.
